The course aims to offer the basic notions of Italian competition and intellectual Property laws by examining: a) the principles of domestic competition statutes; b) the various torts of unfair competition provided for in art. 2598 of the Italian Civil Code; c) the laws concerning deceptive advertising and unfair commercial practices; d) the Italian, European and International regulations concerning industrial trademarks, other distinctive signs used in trade,design and innovative utility models, trade secrets; legal actions and remedies before administrative and judicial Authorities.
A) THE REGULATIONS CONCERNING UNFAIR COMPETITION
a) Enterprise and market.
b) the Italian antitrust law (brief outlines).
c) the statute of unfair competition.
f) Protection of trade secrets.
B) TRADEMARKS AND MODELS
a) Signs identifying products or services from a particular source (firms, trademarks, domain names, other signs de facto used in trade).
b) Well-known marks (marchio di rinomanza).
c) The Community Trademark e the international trademark registration.
d) Quality trade signs (collective trademarks, indications of origin, other protected geographical indications).
e) Design and respective patent.
f) Utility models and respective patent.
C) UNFAIR COMMERCIAL PRACTICES
a) Deceptive practices.
b) Aggressive practices.
d) Deceptive and comparative adverstising.
